Terms of Service

1. Who we are & acceptance

WooChim (“WooChim”, “we”, “us”) provides fit-prediction, size-guidance, and AI virtual try-on tools for clothing. By checking the box at sign-up, creating an account, or otherwise using the service (the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to create an account and use the Service. By using WooChim you confirm that you meet this requirement and that the information you provide is accurate and your own.

3. Your account

• You are responsible for keeping your login credentials secure and for activity under your account.
• You must provide a valid email address and keep your account information accurate.
• Notify us promptly at hello@woochim.com if you suspect unauthorized use.

4. Waitlist and launch communications

Joining a WooChim waitlist does not create an account, guarantee access, reserve a paid service, or require a purchase. If you separately opt into launch and product updates, we may email the address you provide for that purpose. You can withdraw that permission at any time through the unsubscribe link in each message. Our Privacy Policy explains the consent record and limited delivery data we keep.

5. Your content (photos & measurements)

You may upload photos of yourself and enter body measurements and garment details (“Your Content”). You keep ownership of Your Content. You grant WooChim a limited licence to store and process Your Content solely to operate the Service for you — for example, to compute fit scores and to render virtual try-on images on your own photo.

• You confirm you have the right to upload any photo you submit, and that it depicts you (or someone who has authorized you to use their image).
• We do not use Your Content to train AI models, and we do not sell it.
• You can delete Your Content and your account at any time; see the Privacy Policy.

6. How fit predictions and try-on work

WooChim's fit scores, size recommendations, and try-on renders are estimates generated by algorithms and AI, based on the measurements and images you provide and on garment data that may be incomplete or supplied by third parties. They are provided for guidance only. We do not guarantee that a garment will fit, that a recommended size is correct, or that a rendered image accurately depicts how an item will look on you. Always check a retailer's own sizing and return policy before purchasing. WooChim is not responsible for purchase decisions you make.

7. AI processing, analytics & third-party services

To deliver try-on renders and related features, Your Content may be processed by trusted third-party infrastructure and AI providers acting on our behalf. These include, among others, Supabase (database, authentication & storage), Replicate (US — AI render / GPU provider), Stripe (payments), Resend (email), Vercel (hosting & analytics), and Sentry (error monitoring). The Privacy Policy describes exactly what each one receives. These providers process data only to perform the Service.

Optional advertising measurement from Meta, TikTok, and Google loads only after your separate consent. The Privacy Policy explains the limited events sent and how to withdraw that choice.

You acknowledge and agree that to generate a try-on or face-on-model render, your body and/or face photo and the relevant garment image are sent to our AI render provider (Replicate), which is located in the United States. By uploading photos and using these features, you consent to this processing and to the transfer of that content to the United States and other countries where our providers operate, which may have different data protection laws than your own.

We also record usage and event data — the actions you take in the app and in the in-store widget, with timestamps and device/session identifiers — to operate, secure, measure, and improve the Service. When you use the widget on a retailer's store, we may provide that retailer with aggregated and de-identified analytics about how WooChim performs on their products (for example conversion lift, try-on engagement, and return-risk indicators). Retailers do not receive your name, email, photos, or raw measurements. See the Privacy Policy for full details.

8. Acceptable use

You agree not to:

• Upload photos of other people without their consent, or any unlawful, infringing, or sexually explicit content involving minors;
• Use the Service to harass, impersonate, or violate the rights of others;
• Reverse-engineer, scrape, overload, or attempt to gain unauthorized access to the Service or its systems;
• Resell or commercially exploit the consumer Service except under a separate written agreement (see our business/API terms).

9. Plans, billing & beta

Parts of the Service are currently free or in beta and may change, break, or be discontinued. Paid plans, when offered, are billed as described at checkout; fees are non-refundable except where required by law. One-time try-on credit purchases are a consumable digital good and are non-refundable once added to your balance. We may change pricing on a going-forward basis with notice.

10. Intellectual property

The Service, including its software, design, and branding, belongs to WooChim and is protected by law. We grant you a personal, non-exclusive, non-transferable right to use the Service. Renders generated from Your Content are yours to use for personal purposes.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, WooChim will not be liable for any indirect, incidental, special, exemplary, or consequential damages, or for lost profits, lost data, or purchases, returns, exchanges, or wardrobe decisions made in reliance on the Service — including any garment that does not fit or any render that does not accurately depict an item. Our total aggregate liability for any and all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or CAD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless WooChim and its owners, operators, and service providers from and against any claims, damages, losses, liabilities, and reasonable legal costs arising out of or related to: (a) Your Content, including any photo you upload; (b) your breach of these Terms or of any law; or (c) your violation of any third party's rights — for example, uploading a photo of a person who has not authorized you to use their image. This obligation survives termination of your account.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others or to WooChim. On termination, the sections that by their nature should survive (content licence, disclaimers, limitation of liability, indemnification, and governing law) continue to apply.

15. Changes to these Terms

We may update these Terms. If we make material changes we will update the effective date and, where appropriate, ask you to accept the new version. Continued use after changes take effect means you accept them.

16. Governing law & dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to first contact us to try to resolve any dispute informally. Any dispute that cannot be resolved will be subject to the courts located in Ontario, Canada, and you consent to their jurisdiction, unless mandatory local law where you live provides otherwise. To the extent permitted by law, any claim must be brought on an individual basis and not as part of a class action.

17. General

These Terms and the Privacy Policy are the entire agreement between you and WooChim regarding the Service and supersede any prior understandings. If any provision is found unenforceable, the rest remains in effect and the unenforceable part is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor (for example, in a merger or acquisition). We are not liable for delays or failures caused by events beyond our reasonable control.
